§ 32.31 CHIEF OF POLICE; OFFICE CREATED; TERMS.
   (A)   Position created. There is hereby created the position of Chief of Police, who shall be an officer of the village. The President and Board of Trustees, voting jointly, shall appoint the Chief of Police. The Chief of Police shall hold office for the term established by the President and Board of Trustees, voting jointly, or otherwise until his or her successor has been duly appointed and qualified or until his or her removal from office by the President and Board of Trustees, voting jointly.
   (B)   Powers and duties. Under the general supervision of the Village Board, the Chief of Police shall have the following powers and duties:
      (1)   Administrative duties. The Chief shall have authority and responsibility for the management, direction and control of operations and administration of the Police Department.
      (2)   Law enforcement duties. The Chief of Police shall have responsibility for the direction and control of law enforcement matters in the village and shall be responsible for the enforcement of the provisions of this code and the ordinances of the village.
      (3)   Keeper of village jail. The Chief of Police shall be the keeper of the village jail and shall have custody of all persons incarcerated therein and all property pertaining thereto.
      (4)   Duty to keep records. The Chief of Police shall make and keep records and reports concerning the functions of the Police Department as may be required by statute, ordinance or the Village Board.
      (5)   Duty to assign rank of member. The Chief of Police shall designate the rank and grade of the members, and all designations, when approved by the Village Board, shall be binding upon all members of the Police Department.
      (6)   Duty to make rules and regulations. The Chief of Police shall make and prescribe rules and regulations for the conduct and guidance of the members of the Police Department as the Chief of Police shall deem advisable, and all such rules and regulations, when approved by the Village Board, shall be binding upon all members of the Police Department.
      (7)   Discipline, suspension and discharge. The Chief of Police shall have the authority to discipline, suspend without pay, or discharge any member of the Police Department for any neglect of duty, misconduct, or for any other valid reason, provided, however that any member of the Police Department so disciplined, suspended, or discharged shall be entitled, and have the right, within ten days, to file with the Public Safety/Community Affairs Committee of the village a written request for a hearing before the Public Safety/Community Affairs Committee, at which hearing the Chief of Police shall have the right to be present. The Public Safety/Community Affairs Committee shall have full power and authority to dispose of the matter brought before it.
      (8)   Additional powers and duties. The Chief of Police shall have any other powers and duties as shall be assigned to the Chief of Police by law, statute, ordinance, or by the Board of Trustees or its duly authorized committees.
