§ 133.21 UNLAWFUL TO SELL, DISCHARGE OR EXPLODE FIREWORKS.
   It is unlawful for any person to offer for sale, expose for sale, sell at retail or to use, discharge or explode any fireworks within the village; provided, however that nothing in this subchapter shall be construed as prohibiting the use of signals or fuses necessary for the safe operation of railroads or other instrumentalities of transportation, and provided further that the public display of fireworks and explosives when handled by a competent individual and where the display and discharge is of a character and so located, discharged or fired, as not to be hazardous to property or to endanger any person or persons, may be made upon a permit applied for and issued as follows. Application for permits for public displays shall be made in writing by not less than three individuals, filed with the Chief of Police not less than 15 days in advance of the date of the proposed display, and shall be acted upon by the Fire Marshal or persons designated by the President to act in his or her place, with in 48 hours after the application is made, and if approved by the Marshal or designated persons, permit for the displays may be issued by the Village Clerk. A permit to hold a supervised public display shall authorize the sale, possession, use and distribution of fireworks for the approved display only and the permit shall not be transferable.
