§ 95.03 CONDUCT IN PARKS AND UPON BEACHES, ADJOINING WATERS AND PUBLIC PREMISES.
   (A)   No person shall use profane, offensive or vulgar language, or conduct himself or herself in a rough, boisterous or offensive manner, while in any park, upon any beach or bathhouse in, upon or adjacent to the beach, or while in or upon the waters adjoining the park or beach or other public premises within the village.
   (B)   No person shall have in his or her possession or consume any intoxicating liquors while in any park, beach or other public property within the village, and the possession or consumption of any intoxicating liquor by any person while on any public property within the village is hereby declared to be a public nuisance and any person possessing or consuming any intoxicating liquor while on any public property within the village shall be deemed guilty of a violation of this code; provided, that the possession, service or consumption of intoxicating liquors in any park, beach or other public property within the village shall not be deemed a public nuisance and shall not be unlawful if: (1) the possession, service and consumption of intoxicating liquors is at a particular event held on or within the property known as the Kenilworth Assembly Hall, located at 410 Kenilworth Avenue, as long as the property is owned and operated by the Kenilworth Park District and the service of intoxicating liquors at that particular event is approved in advance by the Kenilworth Park District Board of Commissioners and is performed by persons or entities holding a liquor license from the state authorizing such persons or entities to serve intoxicating liquors; or (2) the possession, service and consumption of intoxicating liquors in the park, beach or other public property within the village shall be expressly permitted upon the approval of the Board of Trustees in the specific case for the particular location and event in connection with charitable activities or fund raising for charitable or other similar not-for-profit purposes. Application for the permit shall be filed with the Village Manager. If and when approved by the Board of Trustees, the permit shall be issued by the Village Manager or Village Clerk acting at the direction of the Board of Trustees. The Board of Trustees may impose conditions and limitations as the Board of Trustees deems necessary or desirable in connection with any permit.
   (C)   No person suffering from a fever, cough, inflamed eyes, loathsome, contagious or infectious disease or skin eruption, shall swim, bathe or go into the waters adjacent to any park or beach within the village.
