§ 95.01 HOURS OF USE OF PARKS, BEACHES AND WATERS.
   (A)   The park of the village known as Mahoney Park shall be open for use by the public between the hours of 7:00 a.m. and 10:00 p.m. only from April 1 to and including October 31 in each year, and between the hours of 8:00 a.m. and 6:00 p.m. only, from November 1 to and including March 31 in each year.
   (B)   No person shall swim or bathe in the waters adjoining Mahoney Park, at any time.
   (C)   The beach at and adjoining the water works plant of the village, hereinafter referred to as the Kenilworth Avenue beach, shall be open for swimming and bathing between the official hour of sunrise and sunset only, or as hereafter may be otherwise posted at the entry way at the easterly end of the Kenilworth Avenue entrance thereto, and swimming and bathing at all times other than between those hours is hereby prohibited. When, in the judgment of the Chief of Police, the gate attendant or lifeguard while stationed at the beach, the water is too rough or too cold for swimming or bathing and notice thereof is given by them, or any or either of them, to any person on the beach or using the waters adjacent thereto, or notice is posted thereof at the beach entrance prohibiting swimming or bathing, swimming or bathing is prohibited while the conditions last. The village assumes no liability for any accident occurring upon the beach or for any accident or drowning in the adjoining waters.
   (D)   No person shall swim or bathe in the waters adjoining the Kenilworth Avenue beach of the village unless the person shall first have paid the charge which may from time to time be fixed by the Village Board and of which notice is given by posting at the Kenilworth Avenue entrance to the beach.
   (E)   The Kenilworth Avenue beach of the village, but not the waters adjacent thereto, shall be open for use by the public between the hours of 7:00 a.m. and 10:00 p.m., only from and including April 1 to and including October 31 in each year, and between the hours of 8:00 a.m. and 6:00 p.m., only from and including November 1 to and including March 31, in each year.
   (F)   Any person going in or upon Mahoney Park or the beach thereof, or in or upon the Kenilworth Avenue beach, or into or swimming or bathing in the water adjacent thereto, during the hours when the park or beach is officially closed, or who fails to promptly leave the parks, beaches or waters after notice to so do, shall be deemed a trespasser and be subject to prosecution as a trespasser.
