§ 91.064 AUTHORITY OF OFFICER TO ENTER PREMISES TO SEIZE ANIMALS.
   Any police officer or other authorized officer or agent of the village may enter upon the premises of an owner of any dangerous, mad, fierce or vicious animal, or any animal suffering from rabies, or any animal bitten by another animal afflicted with rabies, for the purpose of seizing it, and if after request therefor the owner of the animal or an immediate member of the owner’s family over 16 years of age shall refuse to deliver the animal to the officer and the officer cannot with reasonable effort catch the animal, he or she may kill it. Knowledge by the officer of one or more of the facts, the affidavit of a citizen of the village stating same, or evidence from a licensed veterinarian that the animal is suffering from rabies, shall authorize the officer to enter the premises and either impound the animal or kill it if not delivered to the officer as set forth herein.
