§ 91.001 DEFINITIONS.
   For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ANIMAL. A dog, cat, fowl, reptile or other living creature commonly understood to be an animal.
   AT LARGE. To be off the premises of the owner, not under the control of the owner or a member of the owner’s immediate family over the age of 12 years, either by leash or otherwise; but an animal confined within the motor vehicle of its owner shall be deemed upon the owner’s premises.
   CAT. All domesticated members of the feline species, male or female.
   DOG. All domesticated members of the canine species, male or female.
   FOWL. Chickens, geese, ducks, pigeons, birds or other species commonly understood to be fowl, but does not include a household pet.
   HOUSEHOLD PET. Any animal harbored or kept exclusively within the residence of its owner, except for occasional and temporary periods outside the residence of its owner in connection with the transportation of the animal to and from the premises of the owner during which time the animal is kept in a cage or similar enclosure in the immediate custody, control and supervision of its owner.
   LEASH. A cord, thong or chain by which an animal is directly and effectively controlled by the person accompanying it.
   OWNER OF AN ANIMAL. Any person owning, harboring or keeping or having the care or custody of the animal; the occupant of any premises on which the animal remains or to which it customarily returns daily for a period of ten days is presumed to be harboring or keeping the animal within the meaning of this chapter.
   SMALL DOMESTICATED ANIMAL. An animal, other than a dog, cat or fowl, which is domesticated in its natural state and propagated and kept as a domestic pet and which, at maturity, will not exceed a weight of 75 pounds and which is not prohibited by this chapter.
