(A) It is unlawful for any person to make any excavation in any street, alley, sidewalk or public place or to tunnel under the same, except in case of emergency and in that case after notification to the Police Department, without obtaining a permit therefor and complying with the regulations contained in this subchapter. In case of an emergency, a permit shall be secured within 24 hours from the time the emergency excavation or tunneling is commenced or the next regular business day of the village.
(B) All construction and excavation in the public rights-of-way by utilities is governed by Chapter 56.
