§ 55.080 NO DIVISION FENCE OVER SIX FEET HIGH.
   (A)   It is unlawful for any person to erect and maintain any fence upon or within any lot or parcel of ground within the village, without first obtaining a permit therefor from the Building Commissioner. Application for a permit shall be filed with the Village Manager and shall show the height, the materials to be used, and be accompanied by a map or drawing showing the location of the proposed fence and of structures on the premises. A fee of an amount as established in the annual fee ordinance shall be paid for each permit issued.
   (B)   It is unlawful for any person to erect or maintain upon the street frontage line or lines of his or her lot or upon the side division line or lines between his or her land or premises and the land or premises of another and within the street frontage setback area required by the zoning regulations of the village which is applicable to his or her premises, any fence unless the fence is constructed with open areas of at least 30% of each square foot thereof (exclusive of posts needed for structural strength) if constructed of masonry, or unless the fence is constructed with open areas of at least 60% of each square foot thereof (exclusive of posts needed for structural strength) if constructed of wood, metal or material other than masonry, and no fence shall exceed four feet in height; and unlawful for any person to erect or maintain upon the side or rear division lines between his or her land or premises and the land or premises of another within the village, or within the side or rear setback areas required by the zoning regulations applicable to his or her premises, any partition or other fence that shall exceed six feet in height.
   (C)   Notwithstanding the provisions of subsection (B) above, any person whose property adjoins, on the rear or side division lines, property of the village used for storage of materials or equipment shall be permitted to erect any partition or other fence which does not exceed seven feet in height along the side or division lines between his or her property and the village’s property back of the street frontage setback area required by the zoning regulations of the village applicable to his or her premises, or within the side or rear setback areas required by the zoning regulations applicable to his or her premises. The erection or maintaining of any partition or other fence in violation of this section is subject to the penalties provided for in § 55.999.
