§ 55.002 PERMIT REQUIRED.
   (A)   It is unlawful for any person to pave, or construct any pavement, on any public street, alley, sidewalk or other public way, or to excavate or to construct any vault thereunder, without first obtaining a permit therefor; and no person shall break into, tear up, raise or lower any pavement or sidewalk or any part thereof, or remove any soil or turf from any public ground without a permit so to do issued by authority of the Village Board. The permit will be granted only upon deposit by the applicant thereof with the Village Treasurer of a sufficient sum, but not less than an amount as established in the annual fee ordinance, to secure the cost of restoring the pavement or sidewalk, soil or turf, which deposit shall be returned to the person making it upon restoration approved by the Village Manager; otherwise the deposit or so much thereof as may be reasonably required, shall be used to make restoration and to pay all costs and expenses connected therewith.
   (B)   All use, construction and excavation in the public rights-of-way by utilities is governed by Chapter 56.
