§ 90.01  KEEPING LIVESTOCK PROHIBITED.
   It shall be unlawful to keep or maintain any cow, horse, pony, mule, chicken, hog, sheep, goat or other livestock on any lot or within any pen, stable or other enclosure or building within the corporate limits. This prohibition shall not apply to that certain location referred to as “Duplin Commons”, nor to any locations owned by the town.

§ 90.02  MINIATURE AND POT BELLIED PIGS; PERMITS; RESTRICTIONS.
   (A)   (1)   The keeping and raising of registered pure bred miniature Vietnamese Pot Bellied Pigs (sus scrofa bittatus) and other similar registered pure bred miniature pigs as household pets shall be allowed in all residential districts, subject to the limitations placed thereon by the following provisions of this section.
      (2)   REGISTERED means registered with a nationally recognized Miniature Pig Association.
   (B)   Miniature pigs, as defined by division (A) above, shall not exceed a weight of 100 pounds; only one miniature pig shall be kept in any household; and the pig shall be kept in a restrained area at all times and shall not be permitted to run at large. No miniature pig shall be allowed outside of the premises of its owner, except on a leash or duly restrained in a vehicle.
   (C)   (1)   The breeding and raising of miniature pigs shall not be allowed within the town.
      (2)   Permitted pigs shall be neutered or spayed, or when any such pig shall give birth to piglets, the mother pig and all piglets shall be immediately removed from the town for weaning and raising.
   (D)   (1)   Any person wishing to keep and maintain a miniature pig within the town shall fill out and present an application form to the Town Clerk stating the applicant’s name and address, the location where the miniature pig will be kept and the registration information on the pig.
      (2)   The application form shall be accompanied by a registration fee of $25 payable to the town.
      (3)   The name, address and location of all owners of miniature pigs shall be kept on file by the Town Clerk at all times.

§ 90.03  COMPLIANCE REQUIRED; EFFECTIVE DATE.
   Persons keeping or maintaining within the corporate limits any animals named in § 90.01 of this chapter, or more than one pot bellied pig as allowed in § 90.02 of this chapter, shall remove them from the corporate limits in order to comply with this subchapter not later than 30 days from the effective date of this subchapter, which was 10-24-1998.

§ 90.99  PENALTY.
   (A)   Any person who violates any provision of this chapter for which no other specific penalty has been provided shall be subject to the penalties described in § 10.99 of this code of ordinances.
   (B)   All persons not complying with § 90.03 of this chapter by 10-24-1998 will be penalized $100 per day for non-compliance.
