7-2-3: PERMIT REQUIRED FOR RETAIL SALES:
The local authority having jurisdiction shall require a permit for the retail sale of nonaerial common fireworks.
   A.   The applications shall be on a form approved by the authority having jurisdiction and shall include the name and address of the applicant, the primary location of the group, each location at which fireworks are to be stored and the applicant's Idaho sales tax seller's permit number, if applicable.
   B.   A bond or valid certificate of public liability and property-casualty insurance providing coverage of up to one hundred thousand dollars ($100,000.00) for personal injury and property damage may be required at the time of application.
   C.   The authority having jurisdiction may assess a fee for issuing a permit under this section, which shall not exceed twenty five dollars ($25.00).
   D.   The permit shall be issued if the application is complete and in compliance with applicable law, shall be valid for the period issuance and shall be nontransferable.
   E.   The permit required under this section may be revoked if the permittee violates any provisions of this chapter. A permit revocation proceeding shall comply with the provisions of title 39 (health and safety), chapter 26 (fireworks) of Idaho Code. The conviction of violation of the aforesaid Idaho Code or any provision of this chapter by the permittee, or by any of its agents, employees, or officers shall constitute a cause, in and of itself, to revoke and deny any subsequent application for a permit.
   F.   The permit shall be displayed in public view at each location listed on the permit application.
   G.   Only local charitable groups may apply for a permit for the retail sale of nonaerial common fireworks. (Ord. 552, 3-9-2011)
