6-3-2: CHILD ON THE STREET AT NIGHT:
It is unlawful for any child being an individual who is under the age of eighteen (18) years of age to be upon any street, highway, road, alley, park, playground or other public places or buildings, or places of amusement, eating establishments, vacant lots and/or any other place without being accompanied by an adult having custodial rights or an adult person designated by the adult having custodial rights, between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M. on any Sunday, Monday, Tuesday, Wednesday, Thursday, or Friday morning, and between the hours of twelve o'clock (12:00) midnight and six o'clock (6:00) A.M. of any Friday, Saturday or Sunday morning; provided, that the provisions of this section shall not apply in the following instances:
   A.   When the child is upon an emergency errand directed by his or her parent or guardian or other adult person having the lawful care and custody of said minor;
   B.   When the child is returning directly home from a school activity, school entertainment, school recreation activity or school dance;
   C.   When the child is either going directly to, or coming directly from, his or her place of residence or place of lawful employment and/or is working at the child's place of lawful employment;
   D.   When the child is attending or traveling directly to or from an activity for the primary purpose of the exercise of first amendment rights of free speech, freedom of assembly or free exercise of religion;
   E.   When the child has in his or her possession the express written permission of his/her parent or legal guardian to be in the public place for the specific purpose stated; or
   F.   A child who is married or who is on active duty in the armed services of the United States or otherwise legally emancipated. (Ord. 420, 11-13-1996)
