The following shall apply to all applications which require outside consultants to assist in the review of the request:
A. If in the opinion of the building official and/or the planning director, the city does not have qualified staff to review certain elements of a proposal, then the building committee of the council may authorize that review be performed by a qualified outside consultant and the reasonable costs of this review may be borne in whole or in part by the applicant.
B. If the city has engaged the services of a consultant who will in turn bill the city, and where the consultant's fee is to be paid in whole or in part by the applicant, no approval or conditional approval will be granted by the planning and zoning commission or the city if, after proper billing through the city, this fee has not been paid by the applicant. C. If in the opinion of the building official and/or the planning director, the applicant has not shown the ability or means to repay the city for engineering services, then the building official and/or the planning director can request an engineering deposit for the desired review of the applicant's proposal. Any deposited funds not used by the city official shall be refunded to the applicant within sixty (60) days of the completion of the city review. (Ord. 522, 12-13-2006)
D. Reasonable fees sufficient to cover the costs of administration, inspection, publication of notice and similar matters may be charged to applicants for business development permits, zoning improvement permits, sign permits, conditional use permits (special use permits), subdivision plat approval, zoning amendments, variances and other administrative relief. The amount of the fees charged shall be as set forth by resolution of the council filed in the office of the city clerk. When the administrator finds it necessary or desirable to have legal review of an applicant's request for a permit or other action, the amount charged by the city attorney or other outside counsel shall be paid by the applicant.
