A. Construction, Demolition And Renovation: The following work within the boundaries of the city shall require a building permit and an institutional controls program (ICP) permit from the Panhandle health district no. 1 (the "district"):
1. Construction of new buildings and additions to existing buildings;
2. Demolition of buildings;
3. Renovation of buildings which would result in removal of ceilings or insulation or excavation within basements or crawl spaces.
Applications for permits from the district must be obtained from the Kellogg office of the district, but must be issued (or the need for a permit waived) by the district prior to issuance of the city building permit.
Application must be made to the district within thirty (30) days of submitting the building permit application to the city and both permits must be approved and issued prior to the applicant commencing work.
B. Excavations: All excavations, except as herein exempted, shall require an ICP permit from the district. Applications for such permits shall be available at the Kellogg office of the district. This requirement shall not apply to: 1) excavations of less than one cubic yard of earthen material, or 2) excavations in a remediated area which do not penetrate the visible delineation lines between remediated and unremediated soil (this barrier is at approximately 1 foot in lawn areas and 2 feet in garden areas) and which do not reduce the depth of the barrier, or 3) areas which have been totally remediated. Application for such permit must be approved by the district prior to excavation.
C. Subdivisions And Planned Unit Developments: All subdivisions and planned unit developments in the city shall require an ICP permit and approval from the district of the developer's plan for dealing with contaminated soil. Such approval must be obtained prior to final plat approval and prior to commencing work.
D. Violations: Should any applicant for a required permit fail to obtain such permit from the district as required by this section, the building permit or subdivision permit issued shall be void and the applicant shall be deemed to have committed a misdemeanor for each day of such violation. Such violation shall be punishable by a fine not to exceed three hundred dollars ($300.00), up to thirty (30) days in jail, or by both such fine and imprisonment. (Ord. 405, 5-10-1995, eff. 5-10-1995)
