(A) Shoulders or drainage swales shall be required instead of curbs with approval of the County Engineer and Village Council when:
(1) Shoulders are required by state law;
(2) Soil or topography make the use of shoulders or drainage swales preferable; or
(3) It is in the best interest of the community to serve its rural character by using shoulders or drainage swales instead of curbs.
(B) Shoulder requirements shall vary according to street hierarchy and intensity of development in accordance with the requirements.
(C) The width of swales shall be determined by site-specific conditions.
