(A) The Commission, at its regular meeting, shall approve, conditionally approve, or disapprove, the final plat within 45 days after it has been filed. If the plat is disapproved, the grounds for disapproval shall be stated in the records of the Commission, and a copy of said record shall be forwarded to the subdivider. If conditionally approved, the subdivider shall make the necessary corrections and resubmit the final plat for final approval to the Commission and Council within 90 days. Therefore, in all cases, the subdivider shall be informed in writing of the action of the Commission.
(B) If a plat is disapproved by the Commission, the subdivider of said plat may file a petition within 30 days after such disapproval in the Court of Common Pleas of Erie County to appeal the action of the Commission.
