§ 100.03 HUNTING SAFETY ZONES.
   (A)   (1)   No person shall at any time take, hunt, trap, kill, pursue, or shoot at any wildlife or wild animals by any means within 400 feet of any structure, including but not limited to a residence, barn or other building, unless specifically exempted by division (A)(2) of this section.
      (2)   It shall be unlawful for any person to hunt deer no closer than 100 feet from any structure provided that the property on which the structure sits is on property adjacent to and bordering on the Kelleys Island airport property. Any person hunting deer on airport property shall have a special nuisance permit issued by the Ohio Department of Natural Resources. Prior to the commencement of hunting deer, pursuant to this section, the permittee shall inform the Mayor as to the days and times the permittee intends to hunt.
   (B)   It shall be unlawful for any person to shoot, shoot at, kill, take or attempt to take any wild bird or wild quadruped along, on, from, across, or within 400 feet of any public street, road or highway within the village.
   (C)   It shall be unlawful for any person to hunt, shoot, shoot at, kill, take or attempt to take any wild bird or wild quadruped from or by means, aid, or use of any aircraft, or any motor driven conveyance or its attachments. Shooting wild animals, except migratory game birds, is permitted from agricultural equipment when being used in normal farm operations. A person who is physically disabled to the extent that he cannot walk may shoot from a stationary vehicle in a field, except on a public hunting area. Paraplegic hunters and hunters missing one or both legs may hunt migratory game birds from stationary motor vehicles.
   (D)   Whoever violates division (A), (B), or (C) of this section is guilty of a misdemeanor of the fourth degree.
