(A) No person shall operate a vessel at greater than idle speed or at a speed that creates a wake within 300 feet of any marina, boat docking facility, boat gasoline dock, launch ramp, recreational boat harbor or harbor entrance on the south shore, from Seaway Marina to the Navorska Dock within the territorial jurisdiction of the village, or harbor entrance, or within any area buoyed or marked as a no wake area, pursuant to R.C. § 1547.61.
(B) Whoever violates this section is guilty of a minor misdemeanor. If, within two years of the offense, the offender previously has been convicted of or pleaded guilty to one violation of this section, it shall be a misdemeanor of the fourth degree. If, within two years of the offense, the offender has previously has been convicted of or pleaded guilty to two violations of this section, it shall be a misdemeanor of the third degree. If, within two years of the offense, the offender previously has been convicted of or pleaded guilty to three or more violations of this section, it shall be a misdemeanor of the first degree. If a violation of this section results in damage to property, injury to persons, or creates a substantial risk of harm or damage to property, or harm to persons, regardless of whether there have been any prior convictions under this section, the offender is guilty of a misdemeanor of the first degree.
