(A) No all-purpose vehicle shall be operated on any street, highway, or sidewalk in the village or on any property owned by the village during the period of each year commencing on Memorial Day and ending on and including Labor Day unless properly permitted by the Kelleys Island Police Department (KIPD) pursuant to the rules and regulations set forth herein.
(1) Eligibility rules.
(a) Permittee must be an island resident or property owner.
(b) Vehicle must have a valid APV plate.
(c) The plate must be registered to an island address and to the resident applying.
(d) A safety inspection shall be conducted by the KIPD. Dealer or factory installed seat belts, a windshield, headlights, brake lights and turn signals shall be required.
(e) Permittee must have proof of insurance.
(f) Permits shall be issued by the KIPD only and shall be valid for a period of one or two years.
(g) Operators must have a valid driver's license.
(2) Permit rules.
(a) Permits that are issued are for UTVs to operate upon Kelleys Island roads during the prohibited summer months.
(b) A maximum of 150 permits may be issued. Permits are not transferable.
(c) Permits are unique, with their own numbers and expiration date.
(d) Permits must be displayed in plain sight with an APV plate.
(e) The use of these permits for UTVs are a privilege and can be revoked for multiple traffic violations and/or dangerous operation of the vehicle.
(f) The permit fee shall be $35 for one year.
(g) Permits must be displayed on the windshield in the bottom left hand corner on the driver's side of the vehicle.
(B) Whoever is convicted of or pleads guilty to a violation of division (A) of this section shall be guilty of a misdemeanor of the third degree and shall be imprisoned for a definite term or fined, or both, which term of imprisonment and fine shall be as provided in § 70.99.
