§ 38.16 CONSISTENT PENALTIES.
   (A)   Disciplinary penalties shall be consistent in their application; that is, penalties shall be similar under similar circumstances.
   (B)   The determination of when and how penalties and circumstances are similar involves judgment on the part of the disciplinary authority which is the Mayor with the consent of Council. Officials shall exercise their judgment based upon:
      (1)   Particular facts of the case;
      (2)   The seriousness of the infraction; and
      (3)   The employee's past disciplinary history.
