10-2-3: PERMIT REQUIREMENTS:
   A.   Permit Required; Exceptions:
      1.   A written permit shall be obtained from the Zoning Enforcer before starting:
         a.   To establish any new use of property.
         b.   To change the use of any building, structure or land from one classification to another.
         c.   To excavate or build any foundation.
         d.   To erect, construct, enlarge or move any building or structure.
         e.   In case of a nonconforming use, to change from one use to another.
         f.   To construct any fence.
         g.   To establish a special use under section 10-9-2 of this title.
         h.   Whenever required by regulations relating to flood hazard areas.
      2.   Governmental bodies, nonprofit organizations, and charitable organizations shall conform to the provisions of this title and shall be required to obtain permits.
      3.   No permit shall be required for:
         a.   Routine maintenance or repair of buildings, structures, or equipment, such as repainting, reroofing, siding of building, relining a blast furnace, or reballasting a railroad track.
         b.   Buildings, structures or land used or to be used for agriculture; however, in the interest of public health, the water supply and sewage facilities in connection with an agricultural dwelling use shall not be exempt.
         c.   To construct a service connection to a Municipally owned and operated utility.
         d.   To take down a mobile, portable, or prefab shed.
   B.   Application For Permit:
      1.   Applications for permits shall be filed in written form with the Zoning Enforcer, shall state the legal description of the property, the name and address of the owner, the applicant and the contractor, and the estimated cost, and shall describe the uses to be established or expanded, and shall give such information as may be required by this title for its proper endorsement.
      2.   All applications shall be accompanied by a dimensioned drawing of the building plot showing the location of buildings and structures, lot areas to be used, auto parking areas, and water supply and sewage disposal facilities.
   C.   Permit Fee: To partially defray the expense of administering this title, the Zoning Enforcer shall charge and collect in advance a twenty five dollar ($25.00) fee for any permit. The fee shall accompany the application for the permit and shall be payable to the City. The fee shall be refunded if the permit is denied.
   D.   Conditions For Denial Of Permit: The Zoning Enforcer shall, where uses would be detrimental to adjacent property and to the ultimate development, discourage and deny permits for:
      1.   Unusual locations of buildings and structures such as excessive setbacks unless justified by topography or other existing features.
      2.   Dwellings and structures of a temporary or partially completed nature.
      3.   Dwellings with less than four hundred (400) square feet of floor area.
   E.   Scope Of Permit; Posting Required: Each permit issued for a main building shall also cover any accessory structures or buildings constructed at the same time on the same premises, and such permit shall be posted in plain sight on the premises for which it is issued.
   F.   Effect Of Permit: Any work or change in use authorized by a permit must be substantially started within one year from the permit's issuance and finished or fully established within two (2) years of starting. Any work or change not started and completed within such periods shall require a new permit.
   G.   Revocation Of Permit: A permit shall be revoked by the Zoning Enforcer whenever he shall find, from personal inspection or from other competent evidence, that the rules or regulations under which it has issued are being or have been violated including, but not limited to, a violation of the provisions of subsection F of this section.
   H.   Recordkeeping: All applications and copies of all permits issued shall be systematically filed and kept by the Zoning Enforcer in his office for ready reference. (Ord. 2017-12, 12-11-2017)
