10-9-2: SPECIAL USES:
   A.   Permit Required; Application:
      1.   The City Council may, by special permit, after a public hearing held by the Zoning Board, and subject to such protective restrictions that the board deems necessary, authorize the location, extension or structural alteration of any of the buildings or uses in any district from which they are otherwise prohibited or limited by this title, and amendments hereto.
      2.   Applications for such permits shall be filed with the Zoning Enforcer and shall be in such form and contain such information as the Zoning Enforcer may from time to time prescribe. Such applications shall be processed and heard in the manner and under the rules and statutes prescribed for amendments to this title.
   B.   Standards For Permit Issuance: A special use permit shall be granted only in the event that:
      1.   The special use will serve the public convenience at the location.
      2.   The location and size of the special use, the nature and intensity of the operation involved in or conducted in connection therewith, the size of the site in relation thereto, and the location of the site with respect to streets giving access thereto shall be such that it will be in harmony with the appropriate and orderly development of the district in which it is located.
      3.   The nature, location, and size of the building or structure, and the nature and extent of the landscaping on the site, shall be such that the special use will not substantially hinder or discourage the appropriate development and use of adjacent land and buildings.
      4.   Parking areas shall be of adequate size for the particular use and properly located so as to prevent traffic hazards and nuisances.
      5.   The proposed special use will not be detrimental to the health and welfare of the public or injurious to other property and improvements in the neighborhood.
      6.   The special use permit must be explicitly restricted so that the use may not be expanded, may not be continued once discontinued for thirty (30) days or more, and may not be transferred or assigned to subsequent owners of the premises. The permit must state that any work or change in use authorized by the special use permit, but not substantially started or substantially established within six (6) months, shall require a new permit; and any work or use authorized by the special use permit but not fully completed or established within one year shall require a new permit.
   C.   Revocation Of Permit: The permit shall be revoked by the Zoning Enforcer when he shall find, from personal inspection or from competent evidence, that the terms and conditions of the permit are being violated. (Ord. 2017-12, 12-11-2017)
