8-3-4: CONTRACT FOR COLLECTION; USE OF CONTRACTOR REQUIRED; EXCEPTIONS:
   A.   Use Of City Contractor Required: All refuse accumulated on residential property in the City shall be collected, conveyed and disposed of by the City or by a contractor selected by the City. No other person shall collect, convey over any of the streets or alleys of the City, or dispose of any refuse accumulated on residential properties in the City.
   B.   Exceptions:
      1.   This chapter shall not prohibit the actual producers of refuse, or the owners of premises upon which refuse has accumulated, from personally collecting, conveying and disposing of such refuse, provided such producers or owners comply with the provisions of this chapter and with any other governing laws or ordinances. The producers or owners availing themselves of this collection exception shall not excuse payment of the fees provided herein. (Ord. 2003-8, 12-8-2003, eff. 1-1-2004)
      2.   This chapter shall not prohibit owners of a single premises at which both residential and nonresidential refuse is produced from entering into a single nonresidential refuse pickup contract with a private collection service to collect and remove all refuse produced on such property. Any owner availing itself of this collection exception shall not be required to pay the fee set out in section 8-3-8 of this chapter for any period it can demonstrate it had a valid contract for nonresidential refuse pickup by a private contractor at such mixed use premises.       3.   This chapter does not prohibit tradesmen such as carpenters, painters, builders, siding contractors, roofers, excavators, plumbers, electricians, landscapers or tree services from collecting, removing, and disposing of debris generated from the practice of their trade on a residential property; nor does it prohibit demolition contractors from removing the debris of demolition of improvements on a residential property; nor does it prohibit vendors of new or used white goods or E goods or other products from collecting and disposing of the items replaced by such sale.
      4.   This chapter does not prohibit any person from collecting or properly disposing of items of any description for which the City has failed to provide a collection or disposal method, provided such collection and disposal is done in compliance with the provisions of this chapter and with any other governing law or ordinance.
