8-3-8: FEES:
   A.   Fees Established; Suspension Of Service: The refuse collection fee for each residential property located in the City shall be per the current collection rate and shall be added to the water bill due for each residential property located within the City. All fees for refuse collections shall be due and payable each month along with the water bill. Notwithstanding the foregoing, the City may charge a separate fee for bulk items or white goods and may require advance payment of such fee as a condition of pick up. The collection fee shall be suspended for periods when the residence is unoccupied, provided one week's prior notice is given the City; and provided, that the period which the premises is unoccupied exceeds one month.    B.   Billing Procedures And Penalties Generally: All billing collection procedures are joint and concurrent with all billing procedures and penalties set out in the combined waterworks and sewerage system ordinances of the City. (Ord. 2003-8, 12-8-2003, eff. 1-1-2004)
   C.   Delinquent Accounts:
      1.   All water/refuse accounts shall be considered delinquent if not paid within fifteen (15) days after the date of the bill. A ten percent (10%) late charge shall be added to all delinquent accounts. All delinquent accounts are subject to the stoppage of services after a notice mailed to the user; provided, however, there is no termination of refuse collection service. Service continues, however the consumer's water may be turned off and a lien placed on the property for unpaid charges. For customers using the water service, said service may be terminated for any delinquency in paying for the service. Water service shall be resumed thereafter only on payment of the accumulated fees for the period of collection, plus a fifty dollar ($50.00) charge for reinstating services.       2.   Currently, a delinquency under the City's combined water and sewer system ordinance for service or a delinquency under this chapter for service can result, at the discretion of the City, in a shutoff of both services per the respective ordinances.
      3.   The stoppage of collection/water services hereinbefore authorized for nonpayment of collection charges shall be in addition to the right of the City to proceed for the collection of such unpaid charges in a manner provided by law for the collection of a Municipal claim.       4.   All charges for solid waste services hereunder are liens upon the real estate for which the service is supplied whenever such charges are delinquent. The City Clerk and/or Collector is authorized and directed to file sworn statements showing the delinquencies and the claim for lien in the Office of the County Recorder of Deeds, which statements shall be deemed notice of the lien and a demand for payment of such charges for such services.
