The town’s Planning Commission and/or Town Council shall not authorize any building permit for a proposed building or structure on any land or subdivided lot within the town unless:
(A) The lot is within a subdivision and the lot was legally created pursuant to this chapter, and a final plat or minor subdivision has been recorded in the office of the County Recorder; and
(B) The lot is a legal lot of record, created prior to the adoption of this chapter.
