Notwithstanding other provisions of this chapter, a person may submit to the County Recorder’s office for recording a document that subdivides a legally existing lot (legally created and existing at the time of the passage of this chapter) in the town by metes and bounds into two lots, without the necessity of recording a plat or record of survey, if:
(A) A positive recommendation has been received from the Planning Commission;
(B) The lot split has been approved by the Town Council;
(C) The parcels (existing lot and new lot) are not traversed by the mapped lines of a proposed street as shown in the General Plan and does not require the dedication of any land for street or other public purposes;
(D) If the lot split is located in a zoned area, each lot in the split meets the frontage, width and area requirements of the zoning ordinance, or has been granted a variance from those requirements by the Board of Adjustment;
(E) The lots from existing paved streets in the town and are accessible to all other required improvements (an applicant may meet these conditions by paving the streets and providing all other required improvements); and
(F) A stamp or written approval from the Town Council, as required herein, is attached to the document to be recorded in the office of the County Recorder.
