§ 151.004 JURISDICTION.
   (A)   This chapter shall govern and apply to the subdivision, platting and recording of all lands lying within the incorporated area of the town.
1    (B)   No person shall subdivide any land for development purposes except in full compliance with this chapter, Chapter 152 of this code of ordinances and other applicable local, state and federal laws. Any plat of a subdivision, filed or recorded without the approvals required by this chapter, is void for the purposes of development, or the issuance of a building permit, as required by UCA §§ 10-9-811 et seq., as amended.
   (C)   No building permit shall be issued by the town for any lot or parcel of land, located wholly or in part within the limits of the town, unless such lot or parcel was legally created or was a legal lot of record existing prior to the adoption date of this chapter.
   (D)   Any owner, or agent of the owner, of any land located in a subdivision, as defined herein, who transfers or sells any land located within the subdivision before the subdivision has been approved and recorded, consistent with the requirements of this chapter, is in violation of this chapter and UCA §§ 10-9-811 et seq. 2 , and other applicable local, state and federal laws for each lot or parcel transferred or sold.
   (E)   A description by metes and bounds in the instrument of transfer or other documents used in the process of selling or transferring property for development purposes does not exempt the transaction from a violation of this chapter, nor the penalties or remedies provided by this chapter and other local, state and federal laws.
