(A) While there are a few holidays that are typically celebrated with legal consumer fireworks, such celebration is prohibited at all times and locations within the city, with the following exceptions, as allowed by I.C. 22-11-14-10.5:
(1) Between the hours of 5:00 p.m. and two hours after sunset on Memorial Day Weekend (Friday to Monday);
(2) Between the hours of 5:00 p.m. and 11:00 p.m. on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8, and July 9;
(3) Between the hours of 10:00 a.m. and 12:00 a.m. (midnight) on July 4;
(4) Between the hours of 5:00 p.m. and two hours after sunset on Labor Day Weekend (Friday to Monday); and
(5) Between the hours of 10:00 a.m. on December 31 and 1:00 a.m. January 1.
(B) Any other time and location must be authorized by the city by permit of $50. It must be approved by the Board of Public Works and Safety, as recommended by the City Fire Chief, or his or her designee.
(C) Fireworks use is not permitted on any city owned property, park, roads, easement, or other publically owned property without specific approval by the Board of Public Works and Safety and the Common Council, as recommended by the City Fire Chief, or his or her designee.
(D) The Fire Chief or his or her designee shall prevent any use of fireworks due to weather conditions or any other safety concerns.
(E) In addition, I.C. 22-11-14-6 states fireworks must be used either on the user’s property or on the property of someone who has given permission. The user must be 18 or be using fireworks under adult supervision. All provisions of this code, other than what is listed above, are in full force.
