(A) Any person violating one or more provisions in this chapter shall be subject to a civil penalty schedule as:
(1) First violation: $25.
(2) Second violation: $50.
(3) Third violation and each after: $100.
(B) Any city police officer o city code enforcement officer are authorized to handle complaints and issue tickets for violations of such ordinance.
(C) (1) Payments of such violations shall be in accordance with Chapter 33 of this code of ordinances, payable to the City Clerk-Treasurer or in a court of general jurisdiction.
(2) There may also be fees associated with an attorney or courts that might apply.
(D) (1) Penalties not stated within § 70.04 found in violation shall be fined not less than $150 for the first offense no more than $250 for the second offense and no more than $350 for the third or subsequent offense with a citation being issued for each violation. In addition, any person found in violation of § 70.04 and/or any provision thereof shall be responsible for court cost and reasonable attorney fees for prosecuting action.
(2) Any truck who is stopped by any law enforcement officer or code enforcement officer of the city is hereby authorized to enforce § 70.04, and any person found in violation thereof shall be fined not less than $150 for the first offense, not less than $250 for the second offense, and not less than $350 for the third and subsequent offense, with a citation being issued for each violation. Trucks parked over night on any city street, alley, or easement of such shall be fined $200 for each subsequent event.
(3) Failure by driver to use good judgement as in § 70.04(F)(1) shall be fined $100.
(4) Residents who fail to correct the situation as described in § 70.04(F)(2) shall be fined $100 to $250.
