§ 70.04 TRUCK TRAFFIC.
   (A)   Definitions. The following definitions for TRUCK, used in this section reflects that a truck vehicle having three axles or a truck vehicle over 5,000 pounds gross vehicle weight, and includes every self-propelled commercial vehicle designed, used, or maintained for the commercial transport of goods or property, and includes semi-trailer trucks and either the tractor pulling the same, or the trailer itself, or trucks that include self-propelled commercial vehicles designed, used, or maintained for commercial transport of goods or property.
   (B)   Restricted travel. No person shall drive any truck or vehicle as defined upon any public street or alley in the city at any time, unless said vehicle is in the process of delivering or picking up goods or materials as address written on bill of loading, or similar documentation must be produced by driver if stopped while driving on any city street.
   (C)   Travel by shortest travel. All trucks and vehicles as defined shall proceed by the shortest combination of state, county, or federal highways and shall not proceed on any city street or alley unless such highways have been closed and the City Board of Public Works and Safety has approved such detour allowing trucks to travel only on designated streets of such detours.
   (D)   Exit from city. All trucks, as defined, when finished delivering or picking up goods within the city shall return to the nearest non-city street by most direct route, unless the truck has subsequent delivery or pick-up schedule within the immediate vicinity for that day. In such cases, the truck may proceed with subsequent delivery or pick-up locations. The driver shall have in his or her possession a written manifest or similar document which shows in a clear manner all of the scheduled delivery or pick-up locations for that day and shall proceed by the shortest and/or marked location.
   (E)   Court costs and attorney fees. Any person found in violation of any provision of this section shall be responsible for court cost and reasonable attorney’s fees for any prosecuting the action in court. Fines may be paid to the Clerk-Treasurer without attorney fees or court costs. If Area Plan is called in to assist, such will be handled by the courts and attorneys accordingly.
   (F)   Blocking or parking on any city streets.
      (1)   No person shall stop, stand, or park a truck on any city streets, alleys, or on any easement of said areas and/or property owned by the city, other than expeditious loading or unloading of freight, except also in the event a moving van is loading or unloading furniture and household goods and operator shall have reasonable time in which to complete such tasks and movement of trucks.
      (2)   A truck tractor may park for a period of one hour at a business site while conducting business. Residents may park only a truck tractor (no trailers), box truck, and the like at their resident private parking lot, as long as it does not create a safety hazard to the flow of traffic, children playing, or neighborhood issues that may devalue property and/or create noise issues.
      (3)   No trucks shall be allowed at a residence that may be operating a business from such residence unless such resident is zoned for such business. Such shall be in the best interest of the neighbor’s sustainable quality of life for all city residents.
   (G)   Exceptions. The provisions of this section do not apply to:
      (1)   Licensed and zoned to repair trucks, operate trucks, or the like;
      (2)   Licensed to carry passengers for hire;
      (3)   School buses;
      (4)   Trash trucks;
      (5)   State, county, and municipal;
      (6)   Farm equipment;
      (7)   Public utility vehicles on official business;
      (8)   Licensed and zoned business who has truck deliveries and/or picking up material on an ongoing basis; and
      (9)   A temporary permit of $25 as may be approved by the Police Department and the Street Superintendent.
