§ 133.06 OPEN BURNING.
   (A)   Open burning of refuse. The outdoor burning of refuse, including, but not limited to, paint, oil, automobiles, tires, plastics, building materials, garbage, trash, debris or any other noxious combustible materials, within the corporate limits of the city is hereby prohibited; however, nothing in this section shall be construed to prohibit the burning of wood, charcoal or other clean fuel oil, or natural gas, in a fireplace, grill or like facility for the purpose of cooking or social heating.
   (B)   Burning of natural vegetation. The burning of leaves, grass clippings, weed clippings, tree trimmings and shrubbery trimmings, and other natural vegetation is permitted within the corporate limits, providing:
      (1)   All burning is conducted between the hours of 10:00 a.m. and 5:00 p.m.;
      (2)   All burning is conducted on private property only;
      (3)   The burning does not create a visibility hazard on roadways or railroad tracks;
      (4)   All fire shall be personally attended unless said fire is in a container with a proper lid; and
      (5)   All fires shall be completely extinguished by sunset.
   (C)   Fire limits. No fires shall be started within 100 feet of any gasoline station, fertilizer plant or storage area, grain elevator, business establishment, school or church. Additionally, it shall be unlawful to build or light any fire in the vicinity of any building or other structure, or any street, sidewalk or pavement so as to create a fire hazard or endanger the property.
   (D)   Atmospheric conditions. The Fire Chief, Mayor, City Council or authorized designee, may prohibit any and all burning within the corporate limits due to atmospheric or weather condition, or other like situations where the risk of danger is enhanced.
