§ 54.17 CHARGE FOR DISCONTINUING SERVICE.
   (A)   If water is disconnected for nonpayment of water and/or sewer bills or other just cause as expressed in Chapters 51 through 55, then a reconnection fee of $100 shall be due and collected by the Water Department. After three reconnection fees have been paid on a property it will be subject to a remote shut off valve installed.
   (B)   All water, sewer and trash bills of the city shall bear the words: "Pay by due date to avoid disconnection". No further notice or process before disconnection shall be required. Any prior ordinance that purports to require further notice or process before disconnection shall be ruled by the requirements of this division (B).
   (C)   Disconnection of water service for nonpayment of water and/or sewer bills may be made at any time 31 days after any bill remains unpaid after it has become due and payable. If a customer moves to a new location within the city's service area and has a reconnect surcharge pursuant to division (A) above, the customer shall be connected at the prevailing charge at that time but any reconnections required by disconnection due to nonpayment shall be pursuant to division (A) above as it would have been applied in the absence of the customer's movement to the new service location.
   (D)   Any unpaid water charges at a service location shall be paid in full before water service is restored to the property served by that service location.
   (E)   Water Department clerks are granted the power to negotiate temporary, reasonable suspensions of the exact application of the requirements of this section to avoid unsafe or unfair results. Any negotiation must be reduced to writing and include, at a minimum, the name of the customer and the property affected, a reasonable schedule of payments stating the amounts and dates the payments are due and must be signed by the customer and a water clerk. The Alderman assigned to supervise the Water Department shall review the negotiations of the clerks as needed to ensure fair and reasonable application of this discretion granted to the clerks.
