(A) (1) The city shall provide for the collection of solid waste in the city in a manner deemed to be in the best interests of the city. The occupant of every dwelling unit, and every commercial or business institution, industrial or agricultural establishment, and private institution within the city shall be a solid waste collection customer of the city. The Jessamine County Board of Education facilities located within the city are exempt from all provisions of this chapter.
(2) Dumpsters are required at the following locations. (Any exceptions must be duly noted and approved by the Public Works Director).
(a) Multi-unit dwellings of 7 units or more (i.e. apartments, townhouses, condominiums, etc.)
(b) All “mixed-use” (i.e. downstairs retail and upstairs dwelling), office, commercial, industrial, or institutional properties that generate 2 cubic yards or more of solid waste per week as determined by historical usage patterns at any one collection location.
(c) All properties with a single master water meter that provides water to multiple businesses and/or residential units if curbside pickup is impractical.
(B) All solid waste from premises to which collection services are provided by the city shall be collected, except hazardous waste, bulky rubbish, or demolition and construction waste, as defined herein. All solid waste collected shall, upon being loaded into collection equipment, become the property of the city.
(C) Tree limbs and yard wastes, as described in § 50.02(E) and (F) respectively, shall be placed adjacent to, and parallel to, the roadside or public thoroughfare for collection. Solid waste containers as required by this chapter for the storage of other residential solid waste shall be placed at the roadside for collection. Any solid waste containers, tree limbs, yard wastes, or other solid waste permitted by this chapter to be placed at the roadside for collection shall not be so placed earlier than 24 hours prior to the regularly scheduled collection day. The containers shall be removed within 24 hours after collection.
(D) Bulky rubbish and construction and demolition waste shall be collected upon request to the city. The city shall establish the procedure and fee for collecting these solid wastes.
(E) Solid waste collectors employed by the city are hereby authorized to enter upon private property for the purpose of collecting solid waste therefrom as required by this chapter. Solid waste collectors shall not enter dwelling units or other residential buildings for the purpose of collecting residential solid waste. Commercial solid waste may be removed from within commercial establishments upon authorization of the owner, or their representative, and approval by a city Public Works Department Supervisor.
(F) All residential solid waste within the city, other than bulky rubbish and construction and demolition waste, shall be collected at least once weekly. All commercial solid waste shall be collected at least once weekly with additional collections if necessary for the preservation of the health and safety of the public.
(G) The city’s service charge for residential collection presumes a "normal" amount of garbage will be collected from each customer as indicated by their “normal” usage history (typically no more than 10-12 kitchen size [13 gallon] garbage bags per week). Any excessive disposal (such as after a yard sale; while moving; a grand spring cleaning) will be collected and then billed according to the bulk disposal rate in the current rate ordinance.
(H) (1) Residential solid waste containers shall be stored upon the residential premises; however, all collection of residential solid waste shall be at the roadside adjacent to the public street or thoroughfare. If the occupant(s) of the residence is physically incapable of transporting the containers) to the curbside, a request for collection adjacent to the dwelling can be made by contacting the Utilities Clerk; authorization can be granted with approval from the Mayor or Public Works Director. There will be no charge for off-curb collection for those who meet the above criteria.
(2) Commercial solid waste containers shall be stored upon private property, unless the owner has been granted written permission from the appropriate agency to use public property for such purposes. The storage site shall be on a hard surface (such as concrete, asphalt) no less than 8 feet square, well drained, and fully accessible to collection equipment, Public Works and public health personnel, and fire department personnel.
(I) All collection vehicles shall be maintained and operated as to prevent spillage of solid waste therefrom.
(J) Under no circumstances will the city collect hazardous waste. Special waste will only be handled as per the applicable Kentucky Revised Statutes promulgated by the Division of Waste Management.
