(A) (1) The occupant of every dwelling unit and every institutional, commercial or business, industrial or agricultural establishment producing solid waste within the city shall provide sufficient and adequate containers for the storage of all solid waste. Exceptions will be made for bulky rubbish and demolition and construction waste to serve each such dwelling unit and/or establishment. All solid waste containers must be maintained in good repair at all times.
(2) All medical waste must be packaged and stored in containers that will guarantee that there can be no possible contact between the waste material and solid waste collection personnel.
(B) The occupant of every dwelling unit and of every institutional, commercial, industrial, agricultural or business establishment shall place all solid waste to be collected in proper solid waste containers, except as otherwise provided herein. Such solid waste containers shall be maintained, and the area surrounding them, in a clean, neat and sanitary condition at all times.
(C) Residential solid waste shall be stored in containers of not more than 40 gallons or less than 10 gallons in nominal capacity. Containers shall be leak proof, waterproof, and fitted with a fly-tight lid and shall be properly covered at all times except when depositing waste therein or removing the contents thereof. The containers shall have handles, bails, or other suitable lifting devices or features. Containers shall be of a type originally manufactured for residential solid waste, with tapered sides for easy emptying. They shall be of lightweight and sturdy construction. The weight of any individual container and contents shall not exceed 75 pounds. Galvanized metal containers, rubber or fiberglass containers, and plastic containers that do not become brittle in cold weather may be used. Disposable solid waste containers with suitable frames or containers as approved by the city may also be used for storage of residential solid waste.
(D) (1) Commercial, business, or institutional solid waste shall be stored in solid waste containers (such as “dumpsters”) provided by the city. These containers will meet the specifications required by the equipment used by the city for the collection of solid waste, and the container will be sized to accommodate the solid waste generated by the entity. The city will solely determine the size of the container and the frequency of collection. The container(s) will be sized to hold the total volume of the solid waste completely within the container for the entire duration between collection cycles. The city will routinely evaluate the usage patterns of each container and will decrease or increase the container size accordingly. The city’s intent will be to size each container for each customer so that it will be full or nearly full prior to each collection.
(2) This solid waste container will remain the property of the city. Only containers supplied by the city will be acceptable. Bulky rubbish and construction and demolition waste shall not be deposited in city-owned containers. Litter and debris shall not be allowed to accumulate around the dumpster and all waste shall be deposited in such a manner as to prevent spilling or blowing out of the container.
(E) Brush and tree limbs less than 4 inches in diameter and less than 8 feet in length shall be stacked at the curb parallel to the street or public thoroughfare when not placed in storage containers.
(F) Yard wastes shall be stored in containers so constructed and maintained as to prevent the dispersal of wastes placed therein upon the premises served, upon adjacent premises, or upon adjacent public rights of way. The weight of any individual container and contents shall not exceed 75 pounds.
(G) The contents of a solid waste container that is not approved will not be collected.
