§ 51.30 VIOLATIONS; WRITTEN NOTICE.
   (A)   Except as otherwise expressly provided herein, any person found to be violating any provision of this chapter or a wastewater permit or order issued hereunder shall be served, either personally or by first class mail, postage prepaid, by the JSEWD, with written notice stating the nature of the violation as provided herein. The offender shall permanently remedy all violations upon receipt of this notice. Such notice shall be deemed received by the person upon actual receipt, personal delivery to the person’s personal or business address or 3 days following deposit of the notice in the U.S. Mail.
   (B)   As contained in §§ 51.25 through 51.29, the notice may be of several forms. Also as contained in those sections, penalties of various forms may be levied against any person for violation of this chapter. The penalties, if levied, shall range from publication of violators in the focal newspaper to fines of at least $5,000 per day per violation or criminal charges.
