(A) Approval of improvements. No final subdivision plat shall be approved by the Planning Commission or accepted for record by the County Clerk until the improvements listed are constructed and approved by the appropriate county or city official having jurisdiction, or a performance bond is posted per § 153.024 or division (B) of this section.

(B) Bond. In lieu of this prior construction, the Planning Commission shall require a performance bond sufficient to cover the estimated cost of the required improvements plus 25%. The bond shall be subject to the condition that the improvements will be completed within a reasonable time set by the Planning Commission, which shall not exceed 18 months after approval of the final subdivision plat. An extension of an additional 6 months time may be applied for by the developer. The Planning Commission may grant an extension for valid reasons, subject to an increase in bonding if substantial construction has not been completed.
