§ 153.038 PRELIMINARY LAYOUT; TECHNICAL INFORMATION.
   The preliminary layout submitted to the Planning Commission shall show or be accompanied by the following information, in addition to the general requirements of § 153.035, except where requirements have been waived.
   (A)   Names and addresses of all adjoining property owners of record and the names of adjacent subdivision developments along with intersecting property lines.
   (B)   A stamped (first-class mail) envelope for each name shown on the list of adjoining property owners, along with a completed "Receipt for Certified Mail" slip (Postal Service Form 3800), a completed "Return Receipt" card (Postal Service Form 3811) and a check or cash equal to restricted delivery postal charges for each envelope.
   (C)   (1)   For subdivisions which will result in the creation of 10 or more residential units, 3 or more commercial units, or 1 or more industrial units, the applicant shall submit to the Planning Commission, along with the preliminary layout, at the time of application for approval of a preliminary layout, an environmental impact analysis, unless waived by vote of the Commission. Generally, the statement should describe:
         (a)   The condition of the air, water, soil and vegetation found within the boundary of the area to be subdivided at the time of submission of the plat;
         (b)   The manner in which the air, water, soil and vegetation will be affected by the development as proposed in the preliminary layout; and
         (c)   Steps which could be taken at the time of development, including alternative strategies, which would minimize the long-term environmental impacts upon the property associated with the subdivision.
      (2)   The environmental impact analysis will be comprised of 3 parts, each containing the following information. Unless otherwise requested by the Planning Commission, the applicant will be expected to use only existing information which may be available through federal, state, regional and/or local environmental agencies or organizations.
         (a)   Part I, Environmental Quality Inventory.  
            1.   Water. Describe the quality of water at the time of application for preliminary layout approval.
               a.   If a water body runs through the property, describe the quality of the water, to include dissolved oxygen and types and levels of contamination (organic and inorganic pollutants and sediments).
               b.   The source of the factors which affect the quality of the water, i.e., on-site (runoff, point of discharge) or upstream (runoff, point of discharge).
               c.   Provide the results of a chemical analysis and coliform count performed on water samples taken from the upstream point at which the water body enters the boundary of the property and the downstream point at which the water body leaves the boundary of the property.
            2.   Air. Describe the quality of the air at the time of application for preliminary layout approval.
               a.   On a general area map show the 4 closest locations at which air samples have been analyzed by the state air quality monitoring agency and the results of the analysis.
               b.   On the map in division 2.a. above, show the direction of the prevailing wind.
               c.   On the map in division 2.a. above, show the location of major industrial facilities within a 1-mile radius of the boundaries of the property proposed for subdivision.
               d.   On the map in division 2.a. above, show the location of any major highway within 1/4 mile of the information, describe the carbon dioxide levels at the point along the highway closest to the property proposed for subdivision.
            3.   Soil. Describe the quality of the soil at the time of application for preliminary layout approval. Using information provided by the U.S. Soil Conservation Service:
               a.   Identify the types of soil found within the boundary of the property and show the location of these soils on a map of the property; and
               b.   Describe the development limitation as determined by the U.S.D.A. Soil Conservation Service of each soil type, to include: depth to rock; slope; permeability; shrink-swell; depth to high water table; erosion; flood hazard; and soil drainage.
            4.   Vegetation. Describe the types and locations of major vegetation found within the boundary of the property proposed for subdivision, with particular attention to the type and size of trees located in the general area, within the property, of any proposed streets or buildings. This description should be accompanied by a map of the property showing the location of trees of more than 8 inches in diameter.
         (b)   Part II, Environmental Impact Statement. Describe briefly, using the information contained in Part I, what environmental changes will occur due to subdivision as proposed via the preliminary plan. The environmental impact statement should address specifically the following questions:
            1.   How will the development of the subdivision, as proposed, affect water quality, due to surface drainage and subsurface drainage?
            2.   How will the development of the subdivision as proposed, affect air quality?
            3.   How will the development of the subdivision, as proposed, affect the quality of the soil?
            4.   How will the development of the subdivision, as proposed, affect the quality of the vegetation?
            5.   How will the development of the subdivision, as proposed, affect the quality of the water, air, soil and vegetation on adjoining properties?
         (c)   Part III, Alternative Development Strategies. Describe how the anticipated environmental impacts could be minimized through use of development and subdivision practices as alternatives to those required by rules and regulations of the Planning Commission, i.e., zero lot lines, planned unit development, water-less toilets and the like.
   (D)   Location, bearings and distances of tract boundary of the proposed subdivision.
   (E)   Location, name, widths and other dimensions of existing streets, together with their approximate grades, easements, property lines, buildings, parks and public properties, on and adjacent to the proposed subdivision tract.
   (F)   Location of pertinent natural features that may influence the design of the subdivision, such as watercourses, floodplains, swamps, rock outcrops, soil types and vegetation including single trees 8 or more inches in diameter.
   (G)   Contours at an interval of not greater than 5 feet, or 2 feet if deemed necessary by the Planning Commission. Contours within 250 feet of the area to be subdivided shall be shown where possible. Contours of the same elevation shall be extended to show their continuation if outside but within 500 feet of the property to be subdivided. Sinkholes, if any, shall be labeled and their low point clearly marked.
   (H)   Location of existing sewers, water mains, culverts and storm drains, if any, including pipe sizes, grades and direction of flow.
   (I)   Location, width and approximate grade of all proposed streets with approximate elevation shown at the beginning and end of each street, at street intersections, and at all points where there is a decided change in the slope or direction.
   (J)   Approximate lot lines, dimension, number and area of all proposed or existing lots, and suggested minimum building setback lines.
   (K)   Proposed provision of water supply, fire protection, sanitary waste disposal, stormwater drainage, on and adjacent to the tract showing proposed connections to existing utility poles and wires shall be required wherever possible. Street trees, street light fixtures, street signs and sidewalks shall also be shown when proposed.
   (L)   Existing and proposed easements and their locations, widths and distances.
   (M)   Approximate sites and their acreages, if any, to be reserved or dedicated for parks, playgrounds, schools or other public uses. Also sites, if any, for semi-public, commercial or multi-family uses shall be shown.
   (N)   Protective covenants shall be placed directly on or attached to the preliminary layout.
   (O)   Shall submit a community services impact analysis as outlined in § 154.078 of the zoning ordinance of the county.
