(A) Whereas any subdivision or resubdivision of land within the area of jurisdiction of these regulations is proposed, the subdividing owner or his or her authorized agent shall apply for and secure approval of the proposed subdivision before plat of the subdivision of land is recorded by the Jessamine County Clerk; before any contract for the sale, transfer or erection of a structure in the proposed subdivision is granted; and before any street or other public ground which has been dedicated is accepted by the legislative body. Approval of a proposed subdivision by the Planning Commission shall be obtained in accordance with the procedure specified hereafter and consisting of 3 steps for all major subdivisions as these are defined in this subchapter: pre-application meeting with the Planning Commission; application for approval of a preliminary layout; and application for approval of a final subdivision plat. In the case of minor subdivisions, as defined in § 153.042, the Planning Commission during its pre-application meeting may waive the procedural requirements to receive an application for a preliminary layout approval, without affecting any of the other requirements of this chapter. Waiving of the procedural requirement shall not waive the fees specified to be collected, but in that case shall accompany the application for approval of the final subdivision plat.
(B) All applications shall be made in writing to the Planning Commission to be received by the Administrative Officer by the day indicated on the application deadline schedule posted in the office of the Administrative Officer.
