(A) Except as provided in division (B) below, in lieu of issuing a uniform citation as provided for in § 92.39, the designated Enforcement Officer responsible for enforcement of any provision of this chapter may issue a warning or an order requiring abatement of a sound source alleged to be in violation, within a reasonable time period and according to guidelines which the designated Enforcement Officer may prescribe.
(B) A warning or an abatement order shall not be issued when the designated Enforcement Officer has reason to believe that there will not be compliance with an abatement order.
