12-1-7: DETERMINATION OF CHARACTER AND CONTROL OF SUBDIVISION:
   A.   The subdivider shall provide a copy of the proposed declaration of restrictions and covenants for the subdivision to the planning and zoning board.
   B.   The planning and zoning board or the city engineer shall confer with the subdivider regarding the type and character of development that will be permitted in the subdivision and may agree with the subdivider as to certain minimum restrictions to be placed upon the property to prevent the construction of substandard buildings, control the type of structures, or the use of the lots which, unless so controlled, would clearly depreciate the character and value of the proposed subdivision and of adjoining property.
   C.   The proposed declaration of restrictions and covenants shall also clearly provide for requirements and procedures for enforcement of any violation of any restriction or covenant. After being reviewed by the planning and zoning board, recommended for approval by the city council, and subsequently approved by action of the city council, these declarations shall be recorded contemporaneously with the final approved and certified subdivision plat.
