12-1-2: DEFINITIONS:
As used in this title, the following terms shall have the meanings ascribed to them:
ACCEPTED PUBLIC STREET: Any street duly accepted by the city council for maintenance after a report and recommendation by the city engineer.
ALLEY: A strip of land, not less than thirty feet (30') in width and not more than forty feet (40') in width, along the side or in the rear of properties and which is intended to provide access to those properties.
APPROVED STREET: Any street, whether public or private, meeting standards and specifications of the city.
ARTERIAL STREET: See definition of Primary Or Arterial Street.
BUILDING LINE: A line within a lot or other parcel of land, so designated on the plat of a proposed subdivision, showing building setback from the lot lines on all sides.
COLLECTOR STREETS: Existing streets designated as such on the official plan of the city and also streets proposed as "collector streets" in new subdivisions which are designed with a right of way width of more than sixty six feet (66') in order to provide an artery for access of traffic from three (3) or more cul-de-sacs and/or minor streets to a primary street.
CUL-DE-SAC: A street having one open end and the other end being permanently terminated by a vehicle turnaround.
EASEMENT: A grant by a property owner for the use of a strip of land by the general public, a corporation or a certain person for a specific purpose.
FINAL PLAT: The drawings and documents described in subsection 12-2-3A of this title.
FRONTAGE: All the property on one side of a street between two (2) intersecting streets, either crossing or terminating, measured along the line of the street or, if the street is a dead end, then all the property abutting on one side between an intersecting street and the dead end of the street.
FRONTAGE ROAD: A public or private marginal access roadway or paved parking lot containing the necessary driveways or trafficways which are located along the frontage of multiple- family, business or industrial zoning districts with regulations for the purpose of establishing minimum distances between points of access to the accepted street and of eliminating the parking of autos on the accepted public street.
LOT: A portion of a subdivision or other parcel of land intended for transfer of ownership or for building development.
MARGINAL ACCESS STREET: A minor street which is parallel and adjacent to primary streets and highways, and which provides access to abutting properties and protection to local traffic from fast, through traffic on the primary streets.
MINOR STREET: A street intended primarily as access to abutting properties.
PARKWAY: A route intended to be used primarily by passenger vehicles which may have a varying width of right of way and which right of way is or is intended to be developed with a parklike character.
PLAT: A map, drawing or chart on which the subdivider's plan of the subdivision is presented and which he submits for approval and intends to record in final form.
PRELIMINARY PLAN: The drawings and documents described in subsection 12-2-2B of this title.
PRIMARY OR ARTERIAL STREET: A street of considerable continuity which serves, or is intended to serve, as a major traffic artery between the various sections of the city area, as shown on the general development plan, as made a part of the official plan, and also streets proposed as "primary or arterial streets" in new subdivisions which are designed with a right of way width of more than eighty feet (80').
PRIVATE STREET: Any street which is under the jurisdiction of a private board of trustees or any street which is privately owned or established.
PUBLIC STREET: All primary, collector, and minor streets which are shown on the subdivision plat and are to be dedicated for public use.
ROAD OR ROADWAY: The paved area existing on the street right of way and not the width of the street right of way.
SIDEWALK: A strip of land dedicated to public use and which is reserved across a block to provide pedestrian access to adjacent areas.
STREET: The width of the street right of way or easement, whether public or private, and shall not be considered as the width of paving or other improvement on the street right of way.
SUBDIVIDER: The person responsible for preparing and recording the plat of the subdivision and for carrying out all appropriate requirements outlined in this title for the subdividing of land.
SUBDIVISION:
   A.   One of the following:
      1.   Single-Family Residential Subdivision Of Land: A single-family residential subdivision shall be one of the following:
         a.   The division of land for single-family residential purposes, into two (2) or more tracts, sites or parcels of three (3) acres or less in area.
         b.   The division of land for single-family residential purposes into tracts of more than three (3) acres where the proposed lot frontage is less than three hundred feet (300').
         c.   The dedication or establishment of a public or private road, highway or street through a tract of land regardless of area.
         d.   The resubdivision of land previously divided or platted into lots, sites, or parcels, containing a total of one acre or more, as long as the remaining lots, sites and parcels comply with the applicable zoning district requirements.
      2.   Planned Zoning District: Any multiple- family, commercial or industrial district included in a zoning district of the zoning ordinance of the city after the effective date hereof shall be considered as a planned zoning district and shall be deemed a subdivision for the purpose of this title, regardless of whether the land is divided for separate sale or is developed on a lease basis. Such subdivision shall be subject to the improvement and design requirements of this title.
   B.   Any sale or contract of sale or agreement to purchase any lot or division of land, either by lot description or by metes and bounds, shall constitute a subdivision of land and require, prior to any sale or contract of sale or agreement to purchase and before the delivery of a deed, the submission of a plat to the planning and zoning board as required by law; however, this subsection shall not apply to land in subdivisions previously recorded, to sales of land used or to be used for orchards, forestry or the raising of crops, upon certification by the planning and zoning board, or to the sale or exchange of small parcels of land to or between adjoining property owners, where such sale or exchange does not create additional lots, or upon certification which must be granted by the planning and zoning board.
SUBDIVISION, MINOR: A subdivision of land into two (2) but no more than four (4) lots, all of which front upon an existing street, and not involving any new streets, other rights of way, easements, improvements, or other provisions for public area and facilities.
