10-11-3: PERMIT REQUIREMENTS:
   A.   Permit Required; Restrictions: It shall be unlawful for any person to place or replace a mobile home on any lot in the city, in or out of a mobile home park, without first obtaining a permit therefor as prescribed in this chapter, and such permit will not be granted if the mobile home does not have a minimum size of eight hundred (800) square feet, or if the mobile home is older than six (6) years from the date of permit application. No permit shall be granted to any person outside a mobile home park who does not own and occupy said mobile home and does not own or is purchasing the site on which said mobile home is located.    B.   Availability Of Application And Other Forms: The building official shall provide the petition, permit application, and other necessary forms.
   C.   Application For Permit: After the requirements of this chapter are met, the person desiring a permit required by this chapter shall apply therefor to the building official.
   D.   Permit Fee: The permit fee shall be based on the number of square feet in the said mobile home, at a rate set by the city council 1 . The permit fee is payable upon making application to the building official, and will be refunded if the application is denied.
   E.   Permits For Mobile Home Replacements: No replacement permit shall be granted to anyone who has not owned said existing mobile home for a period of at least six (6) months prior to the application for a permit. Any mobile home which is unoccupied for a total of one hundred twenty (120) days in any twelve (12) month period shall be declared a nuisance under title 5, chapter 1 of this code. An exemption to this subsection may be sought through a hearing of the city zoning board. (Ord. 1385, 10-29-2002; amd. 2010 Code)
