10-1-3: BUILDING PERMITS AND INSPECTIONS:
   A.   Permits Required 1 ; Exemptions: Building permits are required for any exterior alteration, remodeling or reroofing of a building, or addition to a building, or the construction of a new building. In addition, a permit is also required for the construction of all outbuildings, including, but not limited to, garages, carports, patios, storage buildings (including prefabricated metal), swimming pools and porches. Permits are required even though the structure may be movable. Permits are not required for structures of less than ten (10) square feet. Permits are to be obtained through the building official.
   B.   Classes Of Building Permits: There shall be established the following classes of building permits:
      1.   Class R: Class R building permits are required for erection of a new dwelling or any alteration or addition to a dwelling and attached or detached garages.
      2.   Class B: Class B building permits are required for erection of a new retail, commercial or manufacturing structure or any alteration or addition thereto.
      3.   Class U: Class U building permits are required for the installation or construction of swimming pools (both aboveground and inground models), carports completely open, demolition, gazebo, electric service upgrade, covered patios, decks, fences, accessory buildings and reroofing of any building.
   C.   Building Permit Applications And Specification Sheets: Prior to issuance of building permits, it is the joint duty of the property owner, the construction contractor, and any subcontractor to complete and file with the building official the building permit application and specification sheets, as shown in subsection E of this section. The building official shall have five (5) business days to review these documents and issue the permit or request additional information or changes to the application or specifications.
   D.   Fees Established: There shall be established a schedule of fees for the permits required by this chapter as shown on the respective permit fee calculation forms in subsection E of this section.

Failure to notify the Building Official of the necessity of an inspection and failure to halt construction until the appropriate inspections are completed shall result in a fine of $100.00, plus court costs for each of the property owner and the construction contractor.

   G.   Failure To Timely Obtain Permit; Stop Work Order; Late Application Fee:
      1.   In the event that a party fails to obtain a building permit in a timely fashion as required by this section, the building official may issue a stop work order and the property owner, or construction contractor, or the applicable subcontractor, if any, shall pay, in addition to the established building permit fees, a late application fee as follows:
         a.   Class R and B permits: Five hundred dollars ($500.00).
         b.   Class U permits: Twenty five dollars ($25.00).
      2.   Any work completed prior to obtaining a building permit is subject to removal or other proof of compliance with the applicable code at the expense of the property owner, and/or construction contractor, and/or applicable subcontractor, if any.
   H.   Penalties: Upon conviction, a person violating this section shall be fined as follows:
      1.   Failure to obtain a class R or B building permit before starting construction shall result in a fine of up to two hundred fifty dollars ($250.00), plus court costs, for the property owner, and for the construction contractor and for the applicable subcontractor, if any.
      2.   Failure to obtain a class U building permit before starting construction shall result in a fine up to one hundred dollars ($100.00), plus court costs, for the property owner, and for the construction contractor, and for the applicable subcontractor, if any.
      3.   Failure to notify the building official of the necessity of an inspection and failure to halt construction until the appropriate inspections are completed shall result in a fine up to one hundred dollars ($100.00), plus court costs, for the property owner, and for the construction contractor, and for the applicable subcontractor, if any.
      4.   Each day any wilful violation of any provision of this section shall continue, shall constitute a separate offense. (Ord. 1317, 6-13-2000; amd. 2010 Code)
