8-2-3: DEPOSIT OR BOND REQUIRED:
   A.   Amounts Of Deposits: At the time of making an application for a permit required by this chapter, the applicant shall deposit with the city the appropriate sum as indicated below: (Ord. 1337, 5-15-2001)

   B.   Retaining Deposit; Refunds; Insufficient Deposit:
      1.   The city shall have the right to hold the deposit for up to ninety (90) days. At the end of said ninety (90) days, if the excavation has been properly refilled, the city shall refund the sum deposited less fifty dollars ($50.00) for administrative costs.
      2.   In the event the excavation has not been properly refilled, the city shall have the right to take the deposit and apply it to the cost of properly refilling the excavation.
      3.   In the event the deposit is insufficient to cover the cost of refilling the excavation, then the city shall have further rights as described in this chapter.
   C.   Performance Bond In Lieu Of Deposit: A contractor making the excavation may, in lieu of making the above deposit, submit a performance bond for work involved, payable to the city for an amount up to two hundred thousand dollars ($200,000.00). (Ord. 1337, 5-15-2001)
