(A) Subsequent to the installation of the new waterline, any user connecting to the new waterline shall pay to the city a sum equal to the amount contributed by each user participating in the installation of the original waterline plus 10% of that amount until a date which is the earlier of either:
(1) Each user participating in the installation of the original waterline has recovered its pro rata cost of installation; or
(2) The expiration of five years from the date of connection with the water supply of the city.
(B) Upon receipt of such amount by the city, the city shall pay such amount to either of the following, with no liability to the city for making such payment:
(1) A corporation established by the users of the waterline; or
(2) Such person as the users of the waterline agree, after presentation to the city of a verified writing evidencing such agreement in a writing and releasing the city from any liability for making payment to such person.
