§ 51.01 BOARD OF TRUSTEES ESTABLISHED.
   (A)   There shall be, and there is hereby created, as provided by Chapter 96 of the Acts of the General Assembly of the state, 1921, § 16, as amended, a Board of Trustees consisting of five trustees, which Board of Trustees shall have the management and control of the city water works plant and system. Said Board of Trustees hereby created shall consist of three members appointed by the Mayor, such appointment by said Mayor to be subject to the approval of the Common Council, not more than two of such Trustees so appointed shall be of the same political party and said Trustees so appointed shall be residents of the city.
   (B)   The Mayor and the Chairperson of the Water and Light Committee of the Common Council, shall be ex-officio members of said Board; it being the intention of this provision that said Board of five Trustees shall consist of the Mayor then serving as such Mayor of said city, the Chairperson of the Water and Light Committee, and the three members so appointed as hereinabove provided with the approval of the Common Council.
