It is unlawful for any person to construct a driveway across a sidewalk, or cut or change the construction of sidewalk, curb or gutter without first making written application and obtaining from the public works director or his designee a permit to do so. The acceptance of such permit shall be deemed an agreement on the part of such person to construct said driveway in accordance with specifications stated in the permit and to keep said driveway, particularly all portions thereof that are within the public right of way, in good condition and repair.
(1) Exception To Permit: If the construction of a driveway does not involve either the alteration of an existing sidewalk or a curb cut, then the property owner shall check with the city to verify that the proposed construction of the driveway complies with all other applicable legal requirements.
