4.01.107: SEVERABILITY:
If any section, subsection, sentence, clause, phrase, portion, or provision of this title is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this title. The city council hereby declares that it would have adopted this title and each section, subsection, sentence, clause, phrase, portion, or provision thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses, phrases, portions, or provisions be declared invalid or unconstitutional. This section shall apply to all amendments heretofore or hereafter made to this title. (Ord. 2005-10, 2005)
4.01.108: NO MANDATORY DUTY; CIVIL LIABILITY:
It is the intent of the city council that in establishing performance standards or establishing an obligation to act by a city officer or employee, these standards shall not be construed as creating a mandatory duty for purposes of tort liability if the officer or employee fails to perform his or her directed duty or duties.
