§ 130.04 AIR AND SPRING GUNS.
   (A)   AIR GUN means and includes any air rifle, air pistol, spring gun, spring pistol, B-B gun, pellet gun, paint ball gun, or any other implement that is not a firearm and which impels a pellet constructed of hard plastic, steel, lead, or other hard material or paint with a force that reasonably may be expected to cause bodily harm or damage to property.
   (B)   It shall be unlawful for any person to carry or possess an air gun in any vehicle or on or about his/her person within the village unless:
      (1)   Such air gun is unloaded and/or broken down in a non-functioning state and enclosed in a suitable case, box, or transportation package;
      (2)   While on the person's own land or in his/her own abode or fixed place of business or while on the private property of another with the express consent of the property owner;
      (3)   While on public property, if the person is an invitee on public property for the purpose of display of the air gun or lawful commerce of such air gun;
      (4)   The person possessing such air gun is a law enforcement officer, or a student carrying or possessing the air gun for use in training courses, parades, hunting, or target shooting on school or park district ranges, or otherwise with the consent of school or park district authorities and when the air gun is transported unloaded and enclosed in a suitable case, box or transportation package.
   (C)   No person shall be permitted to fire or discharge in the village any air gun unless such discharge is done with the express consent of the property owner and is done on a safely constructed target range or in such a manner as to prevent the projectile from passing over any grounds or space outside the limits of such property.
   (D)   Any person found to be in violation of this section shall be subject to a fine as established in § 130.99.
