(B) Any person found guilty of violating § 116.30 of this chapter shall be fined $200 for a first offense, $400 for a second offense in a 12-month period, and $750 for a third or subsequent offense in a 12 month period.
(C) Any licensee found guilty of violating § 116.31 of this chapter shall be fined an amount not to exceed $50.
(D) Any license found guilty or violating § 116.32 of this chapter shall be fined $50 for a first offense, $100 for a second offense in a 12-month period, and $200 for a third or subsequent offense in a 12-month period.
(E) Any person found guilty of violating § 116.33 of this chapter shall be fined $25 for a first offense, $50 for a second offense in a 12-month period, and $100 for a third or subsequent offense in a 12 month period.
(F) Any person found guilty of violating § 116.34 of this chapter shall be fined $25 for a first offense, $50 for a second offense in a 12-month period, and $100 for a third or subsequent offense in a 12-month period.
(G) Any person found guilty of violating § 116.35 of this chapter shall be fined $200 for a first offense, $400 for a second offense in a 12-month period, and $750 for a third or subsequent offense in a 12-month period.
(H) Any person found guilty of violating § 116.36 of this chapter shall be fined $200 for a first offense, $400 for a second offense in a 12-month period, and $750 for a third or subsequent offense in a 12-month period.
(I) Any person, business, organization or licensee found guilty of violating § 116.37 of this chapter shall be fined $500.
(J) Any person, business, organization or licensee found guilty of violating § 116.38 of this chapter shall be fined $500.
(K) (1) A person who smokes in an area where smoking is prohibited by § 116.40 shall be guilty of an infraction, punishable by a fine not less than $100 nor more than $250.
(2) A person who owns, manages, operates or otherwise controls a public place and who fails to comply with the provisions of § 116.40 shall be guilty of an infraction, punishable by:
(a) A fine not less than $250 for the first violation.
(b) A fine not less than $500 for the second violation within one year of the first violation.
(c) A fine not more than $2,500 for each additional violation within one year.
(3) Each day on which a violation of this section occurs shall be considered a separate and distinct violation.
